Guardian Early Payment Advantage Plan
The Plan offered in the Agreement covers deliveries beginning November 1, 2008, and will not apply retroactively to any earlier deliveries. This contract will become binding upon receipt of this signed agreement and will remain in force through March 31, 2009 or until contract gallons are exhausted, whichever comes first.
Roy Bros. Oil & Propane and its customer agree to the following:
- Roy Bros. agrees to deliver #2 Home Heating Fuel at a capped contract on an automatic delivery basis.
- Downside Price Protection guarantees that if at any time during the price protection period, the Roy Bros. market rate posted on the date of delivery is lower than your capped price, you will automatically be invoiced at the lower price.
- Customer agrees to pay a one time Program Fee. Other services provided, including cost of labor, materials and other products will be billed to the Customer’s account and are due within thirty (30) days.
- The Customer account must be current at all times. Deliveries must remain on an automatic delivery basis. The Customer agrees to take all deliveries from Roy Bros. If the customer account is not current, automatic deliveries are refused, or if customer obtains fuel from another supplier before the customer has taken its contracted gallons from Roy Bros., we may terminate this agreement.
- If the Customer commits a breach during the contract term the customer may be responsible for paying the difference between market price and contract price on the unused gallons.
- Roy Bros. at the time of signing or within 7 days of acceptance of this contract shall execute futures contracts and/or hedge options with reputable established wholesale fuel oil companies or brokers.
- Roy Bros. cannot be responsible for events beyond its control. This agreement is conditional upon, and subject to, any interruption in supply due to causes including: acts of God, war or economic sanctions, rationing or allocation of normal supply or natural phenomena disaster. Should any of the above events occur, the Customer will be notified as soon as possible of available options, which may include termination of this contract and a refund of any credit balance, no later than thirty (30) days from date of notification.
